The H-1B visa gives a non-U.S. citizen, who has at least a college degree or its equivalent in demonstrable work experience, the opportunity to work in the United States, with the condition that the employer applying for the visa assumes the commitment to pay a salary to that person.

There are many applicants for this visa, so it is necessary to apply for a lottery, and the U.S. Citizenship and Immigration Services (USCIS) announced that "the initial registration period for the maximum number of H-1B visas for fiscal year 2026 will open at noon (Eastern Time) on March 7 and will run until noon (Eastern Time) on March 24, 2025."

In the notice, USCIS detailed that, during this period, prospective petitioners and representatives must use an online USCIS , with which they will be able to electronically each beneficiary who applies for the selection process and pay the respective fee.

The period of stay with the H-1B visa can be up to three years. This period may be extended, but generally cannot be extended beyond six years, although there may be certain exceptions.

How is the H-1B visa processed?

To apply for the H-1B visa, prospective petitioners and their representatives must use a USCIS online to electronically each beneficiary for the selection process and pay the associated registration fee for each beneficiary. The requirements are as follows:

  • Have a job offer in the United States with a company willing to sponsor you.
  • Have a job offer for a position that is professional - requiring at least a 4-year college degree.
  • Have a salary and working conditions that match those of most workers employed in the same field and for the geographical area where they will be working.
  • Have a university degree or a combination of education and/or work experience equivalent to a university degree in a field of study directly related to the position to be filled.
